Overview

This website, limitlesstoronto.ca (the "Site"), is operated by Limitless Toronto ("Limitless Toronto", "we", "us" or "our"), a Toronto-based custom apparel and promotional products decorator offering DTF printing, embroidery and live event customization. These Terms of Service ("Terms") apply to your use of the Site and to any quote, order or purchase of products and services from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

Our Refund Policy, Shipping Policy and Privacy Policy form part of these Terms.

1. Eligibility and accounts

You must be at least the age of majority in your province, territory or state of residence to place an order, or have the permission of a parent or guardian. If you place an order on behalf of a business or organization, you confirm that you are authorized to do so. You are responsible for keeping your account details secure and for all activity under your account.

2. Custom, made-to-order products

All products are made to order and decorated with the logo or artwork you provide. Orders have a minimum of 24 pieces per design. Because products are custom-made for you, they are not eligible for return or exchange except as described in our Refund Policy.

3. Artwork and intellectual property

You can upload your artwork when you order or send it to us afterward. By submitting any logo, design, image, text or other artwork ("Artwork"), you confirm and warrant that:

• You own the Artwork or have all the rights, licences and permissions needed to have it reproduced on products;
• Our reproduction of the Artwork for your order will not infringe any copyright, trademark or other right of any person or organization; and
• The Artwork is not defamatory, obscene, hateful, or otherwise unlawful.

You agree to indemnify and hold harmless Limitless Toronto from any claims, losses, damages and costs (including reasonable legal fees) arising from the Artwork you submit or from our use of it to fulfil your order.

We may refuse or cancel any order, at our sole discretion, if we believe the Artwork may infringe another party's rights or is offensive, hateful, or inappropriate. If we cancel an order for this reason before production, we will refund any amount you paid for it.

You keep all rights to your Artwork. You grant us permission to use it only to prepare quotes, proofs and your order. Any designs, templates or mockups that we create remain our property unless we agree otherwise in writing.

4. Proofs and approval

Before production, we will send you a proof showing your Artwork, colours, size and placement for your confirmation. It is your responsibility to review the proof carefully, including spelling, wording, colours, sizes, quantities and placement. Production begins only after you approve the proof, and your approval confirms that the proof is correct.

We are not responsible for errors in an approved proof. Cancellations and changes are free until you approve the proof. After approval, orders cannot be cancelled, and changes may not be possible or may involve additional cost.

5. Production variations

Decorated products are produced partly by hand, and small variations are normal. In particular:

• Colours may vary slightly between what you see on your screen and the finished product, and between garment dye lots. Exact colour matching, including Pantone (PMS) colours, cannot always be guaranteed, although we work to match colours as closely as possible.
• Placement may vary slightly from piece to piece because garments are loaded onto equipment by hand. Placement within about 1 inch of the approved position is considered within normal tolerance and is not a misprint.
• Product mockups and images on the Site are for illustration and may not exactly represent the finished product.

6. Blank products and availability

We source blank garments and products from suppliers, and their stock can change at any time. If an item becomes unavailable after you order, we will contact you with alternatives and will not proceed with a substitute until you approve it. If no acceptable alternative is available, we will refund you for the affected items.

If you supply your own garments or items for decoration, we are not responsible for defects in those items, and we cannot replace them if they are damaged during normal decoration.

7. Pricing, payment and errors

All prices are in Canadian dollars (CAD). Applicable taxes are calculated and charged at checkout in accordance with Canadian tax rules. Prices, products and services may change at any time without notice.

We work hard to make sure the information on the Site is accurate, but errors can happen. If a product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may refuse or cancel any order placed for that product, even after the order has been confirmed and your payment has been charged. If we cancel an order after payment, we will refund you in full.

We may also limit or cancel quantities, and refuse any order, at our discretion, including orders that appear to be placed by resellers or that appear fraudulent.

8. Shipping, pickup and delivery

Production times, shipping options and delivery estimates are described in our Shipping Policy. Delivery dates are estimates only and are not guaranteed. Risk of loss passes to you when the order is handed to the carrier or picked up by you. You are responsible for providing a correct and complete shipping address.

9. Refunds, misprints and defects

Our Refund Policy explains how we handle cancellations, misprints, damaged or defective items, and orders that do not match the approved proof. Claims must be made by email within 7 days of delivery, with photos.

10. Use of the Site

You agree not to use the Site for any unlawful purpose; to upload viruses or harmful code; to interfere with the security or operation of the Site; to collect other users' information; or to copy, reproduce or resell any part of the Site without our written permission. We may suspend or end your access to the Site if you breach these Terms.

The Site may contain links to third-party websites, such as supplier catalogues. We are not responsible for the content, products or practices of third-party sites, and your use of them is at your own risk.

11. Disclaimer

Except as expressly stated in these Terms and our Refund Policy, the Site and our products and services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Site will always be available, uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Limitless Toronto and its owners, employees, suppliers and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, lost revenue, lost business opportunities, or costs related to missed events or deadlines, arising from your use of the Site or any products or services. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be limited or excluded.

13. Events beyond our control

We are not responsible for delays or failures to perform caused by events beyond our reasonable control, including supplier shortages, carrier delays, equipment failure, power or internet outages, severe weather, labour disputes, public health emergencies or government actions.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the courts located in Toronto, Ontario, unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. The Terms in effect at the time you place an order apply to that order.
